1. Introduction

Welcome to NoWaitingInQ ('we', 'our', or 'us'), a product of Avinju Tech Pvt. Ltd.. By accessing or using our website, mobile application, and services (collectively, the 'Platform'), you agree to be bound by these Terms of Service ('Terms'). If you do not agree to these Terms, please do not use our Platform.

2. Definitions

  • User refers to any individual who registers or uses the Platform to book appointments or join queues.
  • Tenant or Partner refers to businesses (doctors, salons, shops, etc.) that list their services on our Platform.
  • Service refers to the software-as-a-service (SaaS) solution provided by us to manage queues and bookings.

3. Account Registration & Security

To access certain features, you must register for an account using a valid email address or phone number. You agree to:

  • Provide accurate, current, and complete information during the registration process.
  • Maintain the security of your password and accept all risks of unauthorized access to your account.
  • Notify us immediately if you discover or suspect any security breaches related to the Platform.

4. Services & Booking

Role of the Platform: We act solely as an intermediary between Users and Tenants. We provide the technology to manage queues and appointments but do not provide the underlying services (e.g., medical consultation, grooming, retail goods).

Booking Commitment,: When you book an appointment or join a queue, you agree to arrive on time. Repeated 'No Shows' may result in the suspension of your account.

Cancellations: Tenants reserve the right to cancel or reschedule appointments based on their availability. We are not liable for any inconvenience caused by such cancellations.

5. For Tenants (Business Owners)

If you register as a Tenant, you agree to:

  • Provide accurate information about your business, services, pricing, and operating hours.
  • Honor bookings made through the Platform to the best of your ability.
  • Pay any applicable subscription fees for premium features (e.g., Analytics, Staff Management) as per the plan selected.
  • Use the 'Broadcast' feature responsibly and not for spam or harassment.

6. Payments, Subscriptions & Refunds

Subscriptions: Tenants may purchase subscription plans to access advanced features. Payments are processed via third-party gateways (e.g., Razorpay).

Refund Policy: Subscription fees are generally non-refundable unless otherwise required by law or specified in a specific promotional offer. In case of billing errors, please contact [email protected].

Wallet Balance: Credits in your user wallet (earned via referrals) have no cash value, are non-transferable, and can only be used for in-app purchases.

7. Acceptable Use

You agree not to use the Platform for any unlawful purpose, to harass others, or to interfere with the operation of the Platform. We reserve the right to terminate or suspend access to any user who violates these terms.

8. Limitation of Liability

To the fullest extent permitted by law, *Avinju Tech Pvt. Ltd.* shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of your use of the Platform or the services provided by Tenants.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes relating to these Terms shall be subject to the exclusive jurisdiction of the courts in Bareilly, Uttar Pradesh.

10. User Generated Content & Prohibited Items

The Platform allows Tenants to list services, products, and upload images ('Content'). You retain ownership of your Content, but you grant us a license to display it on the Platform.

Prohibited Content:

You agree NOT to list, sell, or promote any of the following on NoWaitingInQ:

  • Illegal drugs, narcotics, or controlled substances.
  • Weapons, firearms, or explosives.
  • Adult content, pornography, or sexually explicit services.
  • Hazardous materials or stolen goods.
  • Any item or service that violates local, state, or national laws of India.

We reserve the right to remove any Content and suspend any account that violates these policies immediately and without notice.We may also report such activities to law enforcement authorities.

11. Intermediary Status & Liability

Avinju Tech Pvt. Ltd. is an 'intermediary' as defined under the Information Technology Act, 2000. We do not initiate the transmission of Content, select the receiver of the transmission, or modify the information contained in the transmission.

We are not responsible for the quality, safety, or legality of the services or items listed by Tenants. Any transaction or agreement is strictly between the User and the Tenant.

12. Public Nature of Business Profiles

For Tenants: By creating a Business Profile on the Platform, you acknowledge and agree that the information you provide (Business Name, Address, Services, Gallery Images) is intended for public consumption. This information will be:

  • Visible to any visitor on the internet (without login).
  • Indexed by search engines (e.g., Google, Bing).
  • Shareable via social media and messaging apps.

You expressly consent to the public display of your business information for the purpose of marketing your services. If you do not wish for this information to be public, you should not list your business on the Platform.
